Background

The Bureau of Export Administration (BXA) was formally established within the Department of Commerce on October 1, 1987, to consolidate export-control and enforcement activities that had been scattered across several agencies. On April 18, 2002, the agency was renamed the Bureau of Industry and Security to reflect an expanded mission beyond pure export licensing. BIS administers and enforces export controls on dual-use goods, technology, and software under the Export Administration Regulations (EAR), with the stated goal of advancing U.S. national security, foreign policy, and economic interests while preventing proliferation of weapons of mass destruction. Its budget and staff grew notably after September 11, 2001, when Congress granted it broader enforcement authority. Over the 2010s and 2020s, BIS became a central instrument of U.S. technology competition with China, adding hundreds of Chinese firms — including Huawei and SMIC — to its Entity List and progressively tightening advanced-chip export restrictions. Under the Biden administration, BIS issued sweeping semiconductor export controls in October 2022 and January 2025. The Trump second term reversed some Biden-era rules (notably the AI Diffusion Rule) while adding new restrictions elsewhere, and BIS press releases have served as the official record of each of those policy shifts. Because BIS is a cabinet-level bureau, its press releases carry regulatory force and express the sitting administration's position directly.
